ACCREDITED EMPLOYER UPDATE (07 April 2022)
Applications will open for the new Temporary Work Visa on 04 July 2022.
Applications for the Essential Skills Work Visa will close on 03 July 2022.
Employers can apply for accreditation from 23 May 2022.
Employers can apply for a Job Check from 20 June 2022.
ACCREDITATION REQUIREMENTS
For most businesses the accreditation must be held by the employer named in the migrant worker’s employment agreement.
It is not possible to be self-employed on an Accredited Employer Work Visa.
Standard Accreditation is for employers who employ up to 5 workers on AEWVs.
High Volume Accreditation is for employers employing more than 5 workers on AEWVs. Other visa holders are not included.
The minimum requirements for all employers are:
• Registration with IRD
• Be profitable
• Have a positive cash-flow
• Have sufficient capital or funding
• Have a plan to ensure the business remains viable
• Businesses in operation for less than 12 months can provide evidence:
o Start up capital or funding
o Cash flow or revenue forecasts
o Existing contracts for work
o GST returns
• Compliance with Immigration, Employment and Business standards
• Completion of Employment New Zealand’s most recent online employer modules on employment rights
• Pay recruitment costs including:
o Advertising
o Recruitment agency fees
o Employer accreditation fees
o Job check application fees
o Trade testing
o Tools (ownership retained by employer)
o Compulsory training and induction
• Note: recruitment costs do not include airfares
• Provide settlement support, including:
o How to get an IRD number
o Industry training and qualification information
o Job or industry hazards
o Accommodation options
o Transport options
o Cost of living o Access to healthcare
o CAB Services
o Relevant community groups
• You must allow time for employees to complete all online Employment New Zealand employee modules on employment rights during paid work hours within one month of each AEWV holder commencing work
• Hold an NZBN number
JOB CHECKS
All jobs must pay the market rate and have terms and conditions that comply with New Zealand employment laws and standards.
If the job pays 200% of the median wage there is no need to advertise.
All other jobs must pay at least the median wage (increasing from $27.00 to $27.76 on 04 July 2022).
The new rate will apply for to all job checks submitted from 20 June 2022.
The job must be advertised for a minimum of 2 weeks on a national job listing website where suitable New Zealanders are likely to apply.
The job advertisement must show significant terms and conditions including the minimum and maximum pay rate, guaranteed hours of work and the location of the job.
The job advertisement must show the estimated actual earnings where a significant portion of the pay is by piece rate, commission or other rates or bonuses that are not guaranteed.
The job advertisement must show minimum qualifications, work experience, skills or other requirements necessary to do the job.
Multiple positions can be included in a single job check.
The job check fee is $610.00.
The fee for a reconsideration of a declined job check is $240.00.
